Oath vs. Affirmation: What’s the Difference?

When you sign an affidavit, the notary will ask you to either:

  • Swear (oath) – usually used by people who are comfortable swearing “under oath.”

  • Affirm (affirmation) – a solemn promise without religious language.

Both have the same legal effect. You can choose the one that fits your beliefs and comfort level. The important part is that you are making a serious promise to tell the truth.
